Abstract

Joseph Schacht’s research on early Islamic law completely changed how Western scholars viewed Hadith literature. He famously claimed that the vast majority of Hadiths were actually fake. According to Schacht, Muslim jurists in the 2nd and 3rd centuries invented these sayings and "back-projected" them to the Prophet Muhammad to give their new laws divine authority. While Schacht’s skeptical approach introduced a new level of historical criticism to Western Islamic studies, modern researchers have found major holes in his methods. This paper looks closely at the main flaws in Schacht's theory. First, it examines his heavy reliance on the "argument from silence"—the flawed idea that if a specific Hadith was not mentioned in an early book, it simply did not exist. Second, it highlights his misunderstanding of how early Muslims transmitted knowledge orally and in writing. Finally, it explores how he completely misinterpreted the "Common Link" phenomenon. While Schacht thought these common links in the transmission chains were the original fabricators, modern scholars like Harald Motzki and M.M. Azami have proven they were actually prominent teachers spreading real historical knowledge. By breaking down Schacht's assumptions, this paper shows that his complete dismissal of the Islamic transmission system is not historically accurate. Moving past this extreme skepticism allows for a much more balanced understanding of how early Islamic law truly developed.
