A Research Overview of ‘Right to Fair Trial’

Abstract

Importance of justice is inevitable in Islamic code of conduct. Terminology of right to fair trail is not found in Islamic jurisprudence as it is commonly used in the contemporary world but,  guaranties rendered by this right is a distinguished feature of  Islamic law which provides enjoyment of all rights to the accused. While, international documents dealing with this terminology, although do not provide exact definition of this term, but give detail of the guaranties entitled to the accused. This article appraises the research overview of the term ‘right to fair trial’
